Two Gainesville men involved in a Park Apartments murder in January 2024 and another Gainesville man charged with sexual battery were indicted on Wednesday.
According to a State Attorney’s Office press release, the Alachua County grand jury indicted Moses Elliott McCoy, 34, for sexual battery on a person under 12 by a person 18 or older, and indicted Marquis Byrd, 30, and Davlin A. Smith, 28, for first-degree murder and conspiracy to commit first-degree murder.
The grand jury reviewed evidence and listened to testimony from law enforcement investigators regarding McCoy stemming from a 2022 incident in Gainesville.
In the other case, Gainesville Police Department (GPD) officers responded on Jan. 9, 2024, to a shooting at The Parks Apartments on 3643 SW 20th Ave. Upon arrival, officers located Rohntavious Hayes, who was dead on scene after being shot multiple times.
Detectives later identified Byrd and Smith as suspects in the murder.
Judge Kristine Van Vorst received the findings from the grand jury and Moses, Byrd, and Smith were remanded to the Alachua County Jail to be held without bond per count one of their charges.
