Alachua County Sheriff’s deputies shoot, kill terrorist suspect

A terrorist suspect was shot and killed Thursday afternoon in Gainesville by law enforcement who were attempting to serve a felony warrant.

According to an Alachua County Sheriff’s Office (ACSO) updated release sent on Friday, ACSO deputies received an Ex-Parte Order for Ali Bayhan, 38, under Florida’s Baker Act, which orders an involuntary health evaluation. The order was issued based on sworn testimony from Bayhan’s family, who expressed concerns with his mental well-being and the possibility that he had a firearm.

ACSO patrol deputies and supervisors reviewed the information provided by Bayhan’s family, which was included with the Ex-Parte Order. After identifying multiple concerning details, the ACSO Warrants Unit Supervisors were consulted, and, based on Bayhan’s mental health status, the belief that he was armed, and the layout of the location and the time of day, they determined to serve the warrant on Thursday morning.

ACSO Communications then received a call from the Florida Department of Law Enforcement (FDLE) Supervisory Agent to give additional information on Bayhan that included recent threats to harm law enforcement, to “blow up” a Jewish synagogue and threats to harm several elected officials. The information was relayed to the ACSO Warrants Unit, which further supported the decision to wait until Thursday to serve the Ex-Parte Order.

On Thursday morning, the ACSO Warrants Unit developed a plan that would allow Bayhan to be taken into custody. Investigators were in contact with the FDLE and learned that criminal charges for terroristic threats were forthcoming.

Investigators conducted surveillance throughout Thursday on a residence at 1405 NW 35th Way, where Bayhan was renting a garage-style apartment. Investigators had hoped Bayhan would leave the residence so he could be safely taken into custody and away from any firearms, but he did not leave the residence at any point.

On Thursday afternoon, Investigators were notified by the FDLE that a warrant for terroristic threats, made to a Tallahassee synagogue, had been issued for Bayhan. They also learned that the U.S. Marshals Service would assist ACSO Warrants Investigators in taking him into custody.

Investigators and U.S. Marshals planned to surround the residence and use a PA system to provide commands instructing Bayhan to exit and surrender. The plan included the use of two marked ACSO patrol vehicles to ensure it was clear to Bayhan that the personnel on scene were law enforcement.

Around 3:03 p.m., Investigators and U.S. Marshals arrived at the residence and issued PA announcements. Within one minute, a male—believed to be Bayhan—exited the garage in an erratic manner and was holding a black object in his left hand and wearing a hooded sweatshirt with the hood up. Bayhan was yelling unintelligible statements and then transferred the black object, later determined to be a cell phone, into his right hand and pointed it toward deputies, appearing to film them. He then lifted the bottom of his sweatshirt, showing a handgun visible in his waistband.

K-9 deputies on scene deployed a K-9 toward Bayhan to apprehend him. Bayhan backed away and reached down toward the handgun in his waistband. The K-9 was recalled and redeployed in another attempt to apprehend him. Bayhan reached down again, grabbed the handgun, and appeared to be pulling the weapon when six ACSO Deputies and two U.S. Marshals shot at Bayhan, who was struck by gunfire and fell to the ground.

Deputies requested emergency medical personnel and, once the scene was secured, rendered medical aid. Upon the arrival of paramedics, Bayhan was pronounced dead on scene.
